I ("Training Attendee") acknowledge that I am voluntarily attending and/or participating in roofing product demonstration and/or training (“Training”) conducted by Roberts Group USA, Inc. dba Stormcure (“Manufacturer”).
Medical Fitness
I confirm that I am medically fit to participate in the Training and that I will immediately inform the trainer(s) if I experience any condition that may affect my ability to participate safely.
Assumption of Risk
I understand that Training may involve the use of roofing materials, resins, chemicals, adhesives, tools, equipment, ladders, or other activities that may present risks of personal injury, illness, or property damage. I voluntarily assume all such risks associated with participation in this training.
Safety Requirements
I agree to follow all safety instructions; use required personal protective equipment (PPE) and comply with Manufacturer’s Training policies. I understand that all products and materials used for Training are to be handled strictly in accordance with their respective Safety Data Sheets (SDS), application instructions, and use guidelines which have been made available to me prior to starting the Training. I also understand that failure to comply with any of the safety instructions may result in removal from the Training session without credit or refund.
Release of Liability
To the fullest extent permitted by law, I hereby release, waive, hold harmless, and Manufacturer, its parent company, its employees, trainers, affiliates, and representatives from any and all claims, demands, damages, or causes of action arising out of or related to my participation in the training, except in cases of Manufacturer’s gross negligence or willful misconduct.
Indemnification
I agree to indemnify and hold harmless Manufacturer from any claims, damages, or expenses (including medical expenses and attorney’s fees) arising from my actions, omissions, or failure to follow safety procedures during Training.
Product & Warranty Disclaimer
I understand that this training is provided for educational purposes only. Attendance or completion of this Training does not extend, modify, or create any warranty beyond Manufacturer’s published product warranties. Manufacturer is not responsible for improper installation or use of its products outside of this Training.
Intellectual Property & Confidentiality
All Training materials, demonstrations, and related content are the property of Manufacturer. I agree not to copy, record, or distribute training materials without Manufacturer’s prior written consent.
Governing Law
This waiver shall be governed by the laws of the State of Texas. If any provision is found invalid, the remaining provisions remain enforceable.
